How to Use Belgium Form 276 Div to Recover Dividend WHT?

How to Use Belgium Form 276 Div to Recover Dividend WHT?

Belgium Form 276 Div allows eligible foreign investors to recover Belgian dividend withholding tax (WHT) that exceeds the applicable double taxation treaty rate. Belgium generally deducts WHT at 30%, while many treaties reduce the rate to 15% or less. The beneficial owner must submit a residence-certified Form 276 Div and supporting evidence to the Belgian Federal Public Service Finance (FPS Finance).

What is Belgium Form 276 Div?

Belgium Form 276 Div is the official form for claiming treaty relief on dividends paid by Belgian companies. It covers the normal refund procedure and a restricted reduction-at-source mechanism.

FPS Finance publishes the multilingual Form 276 Div and its explanatory note. The form records the Belgian payer, beneficial owner, dividend, securities and refund instructions.

Belgium’s standard dividend WHT rate is 30%, as confirmed by FPS Finance’s movable withholding tax guidance. Many treaties reduce this rate to 15% for portfolio investors. Lower rates may apply to corporate shareholders that satisfy participation and other treaty conditions.

Form 276 Div does not create treaty entitlement. Instead, it documents a claim based on an entitlement that the investor must establish under the relevant treaty.

Who can use Belgium Form 276 Div?

The beneficial owner of Belgian-source dividends can use Form 276 Div where a double taxation treaty limits Belgium’s taxing rights. The claimant may be an individual, company or other qualifying person resident in a treaty partner jurisdiction.

An authorised representative can prepare and submit the form. However, the representative must hold a valid proxy granted by someone with authority to act for the beneficial owner.

The claimant must qualify as resident under the applicable treaty. The shares must not be effectively connected with a Belgian permanent establishment or fixed base. Any additional conditions concerning legal status, liability to tax or participation size must also be met.

Foreign states and certain public institutions may qualify for an exemption through a different process. Applicants should therefore confirm that Form 276 Div is the correct route before preparing the claim.

How does the Form 276 Div refund procedure work?

The Belgian company or paying intermediary normally deducts WHT and remits it to the Belgian Treasury. The investor can then claim the difference between the tax withheld and the applicable treaty rate.

The claimant must complete Parts I and II of both copies of Form 276 Div. Part I identifies the Belgian company that paid the dividend. Part II records the beneficial owner, dividend details, treaty declarations and payment instructions.

Both signed copies must go to the tax authority in the claimant’s country of residence. That authority completes Part IV, returns the copy intended for Belgium and retains the other copy.

Residence certification confirms that the claimant resides in the relevant treaty jurisdiction. It does not prove beneficial ownership or compliance with every treaty condition.

The certified Belgian copy and supporting documents must then go by post to the SME Centre for Specific Matters, Team 6, in Brussels. The official FPS Finance refund page provides the current postal address and evidence requirements.

How should the investor complete Form 276 Div?

Part I requires the name and address of the Belgian company that paid the dividend. The applicant should also include the company’s Belgian VAT number where available.

Part II identifies the beneficial owner. Required information includes the full legal name, residence address, legal form and tax identification number. Individuals may also need to provide their date and place of birth.

The dividend section records the nature of the shares, payment date, coupon details, number of securities and net dividend. These figures must match the supporting custody and payment records.

Refund instructions must state the account holder, account number, International Bank Account Number (IBAN), Bank Identifier Code (BIC) and bank details. A clear payment reference becomes particularly important where the refund goes through an intermediary or third-party account.

The claimant must also make treaty declarations about residence, liability to tax, participation size and any Belgian permanent establishment. Each declaration should reflect the wording of the relevant treaty rather than a generic assumption about eligibility.

Which documents must accompany Form 276 Div?

FPS Finance requires a credit advice identifying the beneficial owner. It must show the gross dividend, WHT rate, payment date and tax deducted. For dematerialised securities, the final custodian in the payment chain must provide this evidence.

The claim also requires a bank statement showing the net dividend credited to the beneficiary. The investor’s identity, currency, amount and payment date should reconcile across the credit advice, bank statement and form.

Corporate claimants must provide an extract from the relevant business register. FPS Finance also requests the beneficial owner’s VAT number or, where none exists, its Legal Entity Identifier.

Evidence must confirm that the signatory can legally represent the claimant. Constitutional documents, corporate authorities or an appropriate mandate may establish that authority.

A representative needs a valid proxy from the beneficial owner’s legal representative. Where the refund will go to a third-party account, the claimant may also need to provide specific authority for that person to receive the payment.

When does FPS Finance require transaction records?

Additional evidence applies to higher-value claims. FPS Finance requires a custodian-signed transaction schedule where a treaty reduction claim exceeds €100,000 or a full-exemption claim exceeds €10,000.

The schedule must cover transactions from one year before the dividend payment date until one month afterwards. It should record purchases, sales, securities loans and borrowings.

Relevant details include trade dates, settlement dates, values, quantities, security names, International Securities Identification Numbers and running positions. The document must also identify the securities-account holder and relevant counterparties.

FPS Finance uses this evidence to test whether the claimant held the shares and bore the economic exposure around the dividend date. Large claims therefore require a complete ownership history, not only proof of payment.

Why is beneficial ownership important?

The treaty claimant must be the beneficial owner of the dividend. A custodian, nominee or contractual conduit does not qualify merely because it appears in the payment chain.

Beneficial ownership requires more than legal registration. FPS Finance may examine whether the claimant controlled the dividend, held the shares and remained free from an obligation to pass the income to another party.

Tax-transparent entities require particular care. FPS Finance states that such an entity cannot claim as beneficial owner where the income belongs to its investors or partners. Treaty eligibility may therefore need to be established at investor level.

Market-claim payments also fall outside the dividend refund procedure. Belgium treats these payments as compensation rather than dividends, even where their value reflects the missed dividend.

What rules apply to non-resident pension funds?

A non-resident pension fund seeking treaty or domestic relief must generally hold the shares in full ownership for at least 60 uninterrupted days. A shorter holding period requires evidence that the transaction or arrangement was genuine.

The fund must also show that its purpose consists solely or mainly of managing and investing assets for statutory or supplementary pensions. Constitutional documents, regulatory records and governing instruments can support this status.

The holding-period rule does not replace the general beneficial ownership test. A pension fund must satisfy both the fund-specific requirements and the applicable treaty conditions.

What is the Form 276 Div filing deadline?

The claim must reach FPS Finance within five years from 1 January of the year in which the WHT was paid to the Belgian Treasury. The remittance year will usually match the dividend payment year, but the claimant should verify it.

If the payer remitted WHT during 2026, the limitation period starts on 1 January 2026. The claim would ordinarily need to reach FPS Finance by the end of 2030.

Investors should not treat the final deadline as the operational filing date. Residence certification and custodian documents can take time to obtain, while older evidence may become unavailable.

Can Form 276 Div provide relief at source?

Form 276 Div includes a limited reduction-at-source procedure. It generally applies where the Belgian distributing company provides the financial service itself, including certain registered shares or major holdings.

The certified form must reach the distributing company within ten days after the dividend payment date. The company grants the reduction on its own responsibility.

Portfolio investments held through international custody chains often fall outside this procedure. Where relief at source cannot apply, the investor can pursue the normal refund route.

Which administrative developments should investors monitor?

Applicants should use the form and explanatory note linked on the live FPS Finance website. Historic versions and older calculation examples may not reflect Belgium’s current 30% headline rate.

Current guidance places substantial emphasis on beneficial-owner identification, signatory authority, VAT or Legal Entity Identifier data and transaction histories. This reflects increased scrutiny of securities lending, custody chains and economic entitlement.

Form 276 Div applies to treaty relief. Claims based on Belgian domestic law or European Union principles may require a separate written procedure. Any later domestic claim must disclose treaty relief already obtained and seek only the remaining balance.

How does GTR support Belgium Form 276 Div claims?

At Global Tax Recovery (GTR), we review Belgian dividend records, treaty entitlement, investor classification, beneficial ownership and custody evidence before preparing eligible claims. We coordinate form completion, residence certification, supporting documents, submission and authority queries while maintaining a clear audit trail.

Our service operates on a no-win no-fee model, so fees apply only where we achieve a recovery. We do not guarantee refund amounts or processing times because each outcome depends on eligibility, documentation, custody evidence and FPS Finance’s review.

What should investors remember about Belgium Form 276 Div?

Belgium Form 276 Div is the prescribed treaty form for recovering Belgian dividend WHT above the applicable treaty rate. Belgium generally deducts 30%, while a qualifying treaty may reduce the final rate.

A certified Form 276 Div does not establish the claim on its own. The investor must also prove beneficial ownership, treaty residence, receipt of the dividend and the amount of WHT deducted.

The standard filing period runs for five years from 1 January of the year in which the Belgian Treasury received the WHT. Investors should nevertheless start the process early because missing custody records can undermine an otherwise valid claim.

Belgian dividend WHT that exceeds an investor’s lawful treaty or domestic liability should be treated as recoverable and not simply accepted as an investment cost.
