The fund must also obtain confirmation from its home-country tax authority. This certificate should confirm its pension fund status, income tax exemption and tax identification number.
A fund that pays income tax or conducts material commercial activity may require closer analysis. The same concern applies where an entity combines pension and non-pension functions. Each claimant must satisfy every condition attached to the exemption.
Do all tax-exempt investors qualify for a full exemption?
No. A charity, foundation, endowment or sovereign investor does not automatically qualify for Belgium’s pension fund exemption.
The investor must identify another legal basis for relief. This may arise under Belgian domestic law, a bilateral tax treaty or an international organisation’s founding instrument.

A later domestic claim must disclose any partial treaty refund already received. It should request only the outstanding balance. Duplicate claims create material reconciliation and fraud-control risks.
FPS Finance generally allows five years to submit a non-resident claim. The period starts on 1 January of the year in which Belgium received the WHT. Investors should verify the deposit date rather than rely only on their accounting date.
What documents support an Article 106 pension fund claim?
The FPS Finance Article 106 guidance requires a credit advice for the dividend. It must show the payment date, WHT rate and tax deducted. For dematerialised securities, the final intermediary should issue this advice.

A non-resident saver certificate under Article 117, §2 must contain the prescribed confirmations. It must also identify the dividends covered by the claim.
The home-country tax authority should separately confirm the claimant’s pension fund status and income tax exemption. The certificate must include the claimant’s tax identification number.
Other records include refund bank details, the Legal Entity Identifier and constitutional documents. The file should also explain the fund’s legal structure, purpose and activities. Evidence must confirm the signatory’s authority to bind the fund.
A representative must hold a valid power of attorney. A person with legal authority over the fund must grant that appointment.
For an Article 106 claim above €10,000, FPS Finance requests a custodian-signed transaction statement. It must cover the period from one year before until one year after payment.
Treaty claims apply different thresholds. FPS Finance requests transaction evidence above €100,000 for a reduction or €10,000 for a full exemption.
How does beneficial ownership affect the exemption?
The claimant must beneficially own the dividend and hold the relevant shares in full ownership. A nominee or custodian cannot claim merely because it processed the payment.
Belgium generally treats a tax-transparent entity as lacking beneficial ownership for refund purposes. The underlying investors may need to establish their own entitlement. Their position will depend on the relevant domestic law and treaty.
Omnibus custody structures create an additional evidential burden. Records should connect the pension fund to the securities, dividend, WHT deduction and net payment.
FPS Finance also distinguishes genuine dividends from market claims. Compensation caused by an unsettled securities trade is not a dividend. It therefore cannot support a Belgian WHT refund.

The European Union’s FASTER Directive will introduce digital tax residence certificates. It will also standardise certain relief-at-source and quick-refund procedures for publicly traded securities.
The Council of the European Union requires Member States to transpose FASTER by 31 December 2028. The national rules must apply from 1 January 2030.
FASTER does not currently replace Article 106, Form 276 Div or pension-status evidence. Funds must continue using Belgium’s existing procedures until national implementation takes effect.
